Despite testing that shows its pollution comes from neighboring septic tanks, despite local and state officials' success in securing more than $11 million to address the problem, despite seemingly broad public support to do something, James Island Creek may remain fouled for years to come.

It would be easy to blame the dozens of homeowners on septic tanks who have refused to accept generous offers from either the Charleston Water System or the James Island Public Service District to tie into one of these sanitary sewer systems at little to no upfront cost to them. After all, if all 199 affected property owners did that, there’s good reason to believe the creek’s water quality would bounce back. At least more quickly than it otherwise would.

But the real problem isn't these homeowners, who understandably don't want to have to pay a monthly sewer bill — especially one that easily could cost $100 a month, given the pumps needed to make this new sewer service work — if they can avoid it.

And individual homeowners have little way of knowing whether their septic system is operating well or in fact polluting the creek. Testing to date only indicates septic tanks in general are the prime problem; it can't determine specifically which ones.

No, the primary fault lies with state legislators and public health regulators, who for too long have been content with South Carolina's very lax system for permitting and regulating septic tanks. It's their laws and policies that enable property owners with compromised or failing septic systems to harm our environment at no direct cost to them.

As The Post and Courier's John Ramsey recently reported, the James Island Creek Task Force has secured almost $12 million in federal, state and local money to connect 199 homes to sewer lines at no cost to the property owners, after tests found the creek's main source of fecal bacteria was humans, not wildlife or pets.

But homeowners still need to do their part. The James Island Public Service District hired easement negotiators to talk to property owners one-one one, but about 20 of them won't agree to the easements required to install pump stations. The Charleston Water System's experience has been more worrisome: It has been unable to persuade a single one of its 34 customers to tie in. While the utility hasn't undertaken a survey to determine why, it has heard that some are reluctant to commit to a monthly bill without clear evidence that their own septic tank is part of the problem.

The utilities face a deadline, as the bulk of their money — federal funding from the Infrastructure Investment and Jobs Act — expires in two years if it isn't spent by then.

We support a bill that would prohibit new septic tank permits within two miles of the coast or any other waterway, but lawmakers also need to require monitoring of existing systems to ensure they're working properly — and to give regulators more authority to review septic tank applications for entire neighborhoods rather than considering them only on a home-by-home basis. They also need to reconsider the depths and types of soils where septic tanks may be installed, especially given rising water tables.

Until the state changes its approach, we won't make much progress cleaning up current problems or preventing even more serious ones in the future, no matter how much public money is thrown that way.

JOHNS ISLAND, S.C. (WCSC) - Charleston County held a public hearing Tuesday night to discuss and hear from anyone interested in the development of a large medical village on Johns Island.

The planned development, located between 4357 and 4365 Betsy Kerrison Parkway, called the Island Park Medical Village would take up more than 17 acres.

The medical village has been a topic among residents of the islands for months now with polarizing opinions supporting and against the development.

More than 30 people spoke during public comment and hundreds of letters were sent to the council in opposition.

Developers are requesting to rezone the land from low-density residential to large-scale medical office park with almost 160,000 maximum square feet of business space.

The medical village was proposed to Charleston County Planning Commission Members back on November 13 with all 7 members denying the zoning request.

Tuesday night, the questions raised included what types of medical options and concerns about traffic.

“We do agree that we need medical facilities, that we do need access,” Long-time Johns Island Resident, Tamara Butler, says. “My question is just what kinds of medical facilities are going to be there and what services are going to be provided.”

Almost 900 property owners on Kiawah Island were surveyed with 80% saying they are against the medical village and think the size of the project is too large.

“In this particular instance, the site of it, the location, the scope and the scale, feels out of character with the area of the island,” Lowcountry Land Trust President Ashley Demosthenes says.

However some community members want the development, sharing why the area needs accessible medical facilities closer to their homes.

“We lack health care. So, this project, the wellness village, actually helps alleviate a lot of that for us because now we’re going to go in a different direction,” Long-time Johns Island Resident, Jim Hart, says.

Developers say they have held meetings to hear from the community about what they want out of the project, and have reduced the project’s size by 25%.

“We care about the community. All we want to do is to provide a development that meets the needs of the people, to curtail the traffic and to allow people to have a choice,” project developer Jill Skerchek says.

With no action being taken, the developers will present the plan again in two weeks to the county council with any possible changes they make in the meantime.

CHARLESTON COUNTY, S.C. (WCIV) — Clean-up efforts are underway after vandalism resulted in a 60-gallon diesel fuel spill on Johns Island, officials with Charleston Water System said Monday.

The diesel fuel spilled into a stormwater ditch behind homes along Colonel Harrison Drive that leads to the Stono River. Residents initially discovered and smelled the fuel spill over the weekend. The South Carolina Department of Health and Environmental Control was called on Sunday to help with the spill.

“Our contractor cleaned up a portion of the spill, immediately called in a professional environmental remediation company, and notified SC DHEC and the EPA’s National Response Center,” said Mike Saia, Charleston Water System's public information administrator. “It may take several days for them to recapture all remnants of the fuel.”

This is the third instance of vandalism to contractor equipment in recent weeks, and the Charleston County Sheriff's Office is investigating.

“I mean it is a very, in depth vandalism. It's not just a rock through the window. It’s someone who came out here to destroy this 200-something thousand-dollar machine,” said Chad Hunter, owner of Hunter Landworx Construction, the contractor onsite.

Hunter showed up to his Johns Island job site Monday expecting to quickly finish a project he’s been working on since October. Instead, he found his machinery completely vandalized.

“There are wires in there, cut and hidden like that. We wouldn't be able to find it if we didn't see that all the fuel around it, my guys would've gotten in the machine. He put rocks and all in our engine to try to blow the engine up,” Hunter said.

But the damage doesn’t stop there.

The vandalism led to a 60-gallon diesel fuel spill into the surrounding area along the Stono River. Charleston Water System owns the construction project, and its staff says they’ve never seen damage this bad.

“We don't see a lot of vandalism. If we do, it's very, very minor, and easy to repair. But this is a different situation because not only did the person damage the equipment related to the job, but they've also damaged the environment,” Saia said.

Saia said they were able to soak up as much of the liquid fuel as possible and the Coast Guard confirmed to CWS that the spill didn't reach the river.

Now, Hunter must pick up the pieces.

He said the damage to his machine alone will cost a few hundred thousand dollars and his crews are now behind on all their current projects.

“We're out here to clean up somebody's mess as well as take time from our family and slow down the project. I mean, it's hurting everybody, the neighborhood, everything around us is just getting messed up from one person,” Hunter said.

“One hour's worth of work is causing weeks of fix-up.”

California-based Auberge Resorts Collection plans to debut its first planned luxury hotel in South Carolina come 2024 in the form of The Dunlin, located within the Kiawah River master-planned community on Johns Island.

In partnership with real estate developer The Beach Co. and private investment and management company McNair Interests, the project is set to have a January groundbreaking.

The Dunlin property will include 72 cottage-style guest rooms and suites and 19 villas, as well as a main lodge and porch, great rooms and a library lounge. Amenities encompass a pool with cabanas, full-service spa, community farmstead, and access to the community’s Spring House riverfront swim and fitness facilities.

A riverfront restaurant with outdoor deck will also be available, as will two event spaces, including a 10,000-square-foot indoor-outdoor event hall.

“We are pleased to partner with Auberge Resorts Collection to create The Dunlin, which will be one of the most remarkable new resorts in the country,” Beach Co. CEO John Darby said. “Auberge has a terrific track record of creating the most unique hospitality experiences in the world, and this endeavor’s intimate setting will bring highly personalized service with a coastal experience inspired by the local environment.”

Built into the Kiawah River community, which puts emphasis in natural surrounding elements, The Dunlin will consist of 2,000 acres of land with 20 miles of riverfront nature trails and marshlands. Guests will be able to participate in nature excursions on the property, including fly fishing, crabbing and boating, as well as paddle boarding, hiking and biking.

Architect Robert Glazier was chosen to design the resort, and Amanda Lindroth of Lindroth Design will lead the interior design of the property.

Construction financing was provided by United Bank’s Charleston offices.

JAMES ISLAND, S.C. (WCSC) - The site of a proposed preschool on James Island is causing some neighbors to worry about what their yards will look like during a storm or what the traffic will look like during rush hour.

The city of Charleston’s Design Review Board approved the basics, like what kind of building materials and plants the developer wants to use, for example, at the proposed Goddard Preschool located at 1137 Folly Rd., at Tuesday night’s meeting.

However, neighbor Matthew Pertuset says he’s more worried about what the city will review later on.

“How is that going to affect the, not just the people that back up, but the entire neighborhood?” Pertuset said.

The proposed preschool sits directly behind Pertuset’s home in the Queenborough neighborhood. He says he’s worried about the design of this building’s drainage because of how it already acts during storms.

“We’re already holding water,” Pertuset said. “So, for that to come up even more, I’m not sure. So, it’s a huge concern.”

But Robert Summerfield, the director of planning, preservation and sustainability for the city of Charleston, said because they have some of the most comprehensive stormwater regulations in the region, no project could make the problem worse but could only improve it.

“They’re working very hard to make sure that they are utilizing the existing wetlands on site and enhancing that as a stormwater catchment area,” Summerfield said.

But that’s not the only concern.

“If it is going to be a pickup, you know, we’re right here on Folly Road, how does that look during rush hour traffic in the mornings and the afternoons?” Pertuset said. “Is it going to get pushed into our neighborhood for us to deal with or is it just going to come to a stop on Folly Road?”

Summerfield said the city has already thought about it.

“We have created a drop-off low space so that cars, as they come in and drop their children off or pick them up, will actually flow through the site so that there’s a queueing situation that will occur so that people aren’t ideally not queueing out on Folly,” Summerfield said.

Neither the Goddard School nor the applicant, AAG Architects for Vista 26, LLC, have responded to requests for comment.

However, Pertuset said no matter what comes on this property, he just wants the city to be thorough with their plans.

“It is something that the community needs,” Pertuset said. “I think James Island could afford to have another preschool.”

Summerfield said the city will discuss more drainage specifics once the developer submits the next step to the Technical Review Committee. They will have to pass all initial designs before that is done and there’s currently no timeline of when that might take place.
